When a single recommendation crosses domains — the client sells a policy and reinvests the proceeds — note both in the compliance memo, because the two agencies review different halves.
The conduct standard is layered. Whatever binds you federally — the Advisers Act fiduciary duty for an investment adviser representative, Regulation Best Interest for a registered representative, or CFP Board’s fiduciary duty covering all financial advice since June 30, 2020 — applies alongside state requirements. West Virginia, like most states, has moved toward best-interest standards for annuity recommendations following the NAIC’s 2020 model revisions. Clients bring symptoms, not questions about the secondary market. Five patterns account for most West Virginia files.

A term conversion deadline. Conversion rights normally expire at a stated attained age or policy year, and once closed a term policy has essentially no secondary-market value because a buyer needs coverage that will exist at the insured’s death.
A broken no-lapse guarantee. Guaranteed universal life contracts void the guarantee when premiums are late or short, and most owners never learn it happened.
An employer or union group policy at retirement. West Virginia’s industrial and public-sector employment history means group certificates show up constantly. Portability and conversion rights, and their deadlines, determine whether anything of value survives the retirement date.
Screen on four facts before requesting documents: insured age 70 or older (or younger with a serious diagnosis), face amount of at least about $100,000, a documented health impairment, and no remaining need for the death benefit. Six Exits, Priced
Do not list alternatives. Price them. A number next to each line is what converts a recommendation into a defensible file.
- Keep and fund. Annual outlay on guaranteed charges to carry the contract to age 95. Sometimes the answer is affordable and the client’s alarm was unfounded.
- Reduce the face amount. Cutting the death benefit reduces the cost of insurance base and can restore sustainability at a premium the household can actually pay — often the most realistic answer for a West Virginia client on a fixed income.

- Accelerated death benefit. For a terminally or chronically ill insured with a qualifying rider, payments are generally excluded from income under Internal Revenue Code section 101(g), carry no transaction fees, and fund faster than a sale. Check this before shopping anything.

Then the workflow. Disclose any compensation in writing, or record in the file that none exists. Let the client contract directly with the licensed broker or provider so you stay out of the chain of title. Reconvene at the offer and compare it to every priced alternative. Budget 60 to 120 days from first review to funding, and expect medical records retrieval from rural practices to be the slowest step.
When to Decline
Put the negative recommendation in writing. In a state where many households hold modest coverage, this will be the more common outcome.
The face amount is under about $100,000. Life expectancy underwriting, legal review, and escrow costs are largely fixed and do not scale down. Recommend a nonforfeiture option, a face-amount reduction, or surrender instead.
The insured is healthy for their age. Buyers price projected mortality and projected premium years. A 72-year-old with unremarkable records produces a long life expectancy and an offer that frequently does not clear surrender value.
Someone still needs the benefit. A special needs beneficiary, a surviving spouse with no other resources, or family property that would have to be sold in a hurry without the death benefit. Solve the premium, keep the coverage.
A qualifying rider pays more. Accelerated death benefits usually beat a settlement for a terminally ill insured on both amount and speed, with no transaction cost.
The client did not raise the idea. Unsolicited contact about an existing policy, pressure from a relative with a financial interest, and any demand for an upfront fee are elder financial exploitation patterns rather than sales processes. In a legitimate transaction, compensation comes out of closing proceeds and never from the client in advance. Report unlicensed activity to the Offices of the Insurance Commissioner.
Capacity is uncertain. If decision-making is deteriorating and no fiduciary has been appointed, stop and route to counsel rather than proceeding on a signature you are not confident about.
