The Worst Cost-to-Assets Ratio in the Country
Recent editions of the CareScout (formerly Genworth) Cost of Care Survey have placed West Virginia’s median semi-private nursing home room well above the national median, commonly in the range of roughly $11,000 to $13,500 per month — verify the current figure directly. Set that against a state whose median household income and median household net worth both rank near the bottom nationally, and the arithmetic is brutal.
Do it in front of the family. At $12,000 a month, a $90,000 settlement funds about seven and a half months. A $150,000 settlement funds about a year. Most West Virginia clients do not have $150,000 policies. The realistic outcome for a typical file is that liquidating the policy buys six to nine months, after which the client is on Medicaid anyway and the death benefit is gone.
That is not an argument against ever doing it. It is an argument for being precise about what the money is buying. The 2024 Agency Split and the Waiver Slot Problem
Effective January 1, 2024, West Virginia divided the former Department of Health and Human Resources into three agencies: the Department of Health, the Department of Human Services, and the Department of Health Facilities. Medicaid is administered by the Bureau for Medical Services, which now sits inside the Department of Human Services. Update any template memo, referral list, or client handout that still names DHHR.
The Aged and Disabled Waiver is the principal home and community based program for older adults, and it has historically operated with a managed enrollment structure rather than open-ended entitlement — meaning a client who meets the level of care criteria may still wait for an available slot. Confirm current enrollment status and any waiting list with the Bureau before telling a family that home-based care is an option, because a plan built on waiver services that are not available is not a plan.
This interacts directly with the settlement question. Where a waiver slot is not immediately available, private-pay funding may be what keeps a client at home rather than in a facility, which is a materially different use of proceeds than simply prepaying a nursing home. It is often the strongest argument for liquidity on a West Virginia file.
The eligibility arithmetic is federal: a single applicant for institutional or waiver coverage is generally limited to $2,000 in countable resources, with a special income level cap of 300% of the SSI federal benefit rate — a figure adjusting each January that sat just under $3,000 per month heading into 2026. West Virginia files routinely include assets that do not appear in national planning literature. Fractional mineral interests inherited through several generations of undivided family ownership. Surface acreage with no marketable title. Small interests in family cemeteries and rights of way. Royalty streams from wells that may or may not still produce. Each of these is a resource question and each is genuinely hard to value.
Two practical consequences for the life insurance decision. First, do not liquidate the policy before you know whether the other assets already disqualify the client — solving a $14,000 cash surrender value problem is pointless if an unvalued mineral interest is going to hold up the application anyway. Second, some of these interests generate small periodic royalty income that affects the income calculation and the qualified income trust funding, and families frequently forget to disclose them.
Order of operations on a West Virginia file: inventory everything first, including the interests nobody thinks of as property; get the mineral and surface questions to an attorney who does that work, because valuation and marketability are legal questions; and only then decide what to do about the life policy. Reversing that order produces a client who sold a policy for nothing.

Counting and Pricing the Life Policy
Policies on the same insured are excluded as a resource only when their combined face value is $1,500 or less. Above that threshold the entire cash surrender value counts — the whole amount, not the excess. Term insurance has no cash surrender value and generally is not counted, though it is disclosed. The $1,500 test aggregates, so two small burial policies from different companies defeat the exclusion for both.
The state values a retained policy at cash surrender value — a contract formula computed without any reference to the insured’s health. A licensed buyer prices health, the death benefit, and the ongoing cost of carrying the contract. On a policy insuring someone in real decline those numbers differ substantially. Whether an agency may look through cash surrender value to a documented market offer is unsettled; treat it as unsettled, document your analysis, and do not represent an answer to a client. Request in writing at intake: a carrier statement of current cash surrender value, and an in-force illustration showing the premium required to carry the policy to maturity. The illustration reveals both whether a supposedly paid-up policy will actually lapse and whether an automatic premium loan has been quietly consuming the contract for years — a pattern common on old whole life policies where the owner stopped paying without realizing the carrier was borrowing on their behalf.
Threshold facts for a market review: permanent coverage, or term with a live conversion rider; a face amount at or above $100,000; the policy still in force; and a competent owner or a durable power of attorney with express authority over insurance and the disposition of policies. Below roughly $25,000 of face value, tell the client plainly that no meaningful market exists.
Sale, Surrender, Gift: Three Different Events
A sale to a licensed provider at an arm’s-length price supported by competing offers is an exchange for value. Under the 60-month look-back created by the Deficit Reduction Act of 2005 and codified at 42 U.S.C. § 1396p(c), it is not a transfer for less than fair market value and creates no penalty period. It converts an asset into cash, which counts as a resource in the month after receipt.
A surrender to the carrier is equally an exchange for value and equally unpenalized. It simply produces less on a policy insuring someone whose health has declined, because surrender value ignores health entirely. Choosing surrender over a documented higher offer is a suitability question and belongs in the file with both numbers.
A gift — assigning the policy to a child, or distributing proceeds after closing — is a transfer, and the uncompensated value is subject to penalty analysis. This is where essentially every real penalty in these files comes from. On short-runway West Virginia files where the family knows the money will not last, the temptation to move some of it to children before it is consumed is strong. Address it explicitly and in writing at closing.
Documentation the file needs: the offer summary showing what more than one buyer proposed; the closing statement showing gross price and every dollar of intermediary compensation; a carrier statement of cash surrender value dated near the sale; bank records tracing the money; invoices and paid receipts for each spend-down expenditure; and a memo recording the alternatives considered. Documentation, Timing, and Spend-Down
Resources are generally assessed as of the first moment of the month, so proceeds funded on the 29th are countable for that month and the next unless converted. On a short-runway file the timing is tighter than elsewhere: a two-month gap during which the client is over the resource limit and privately paying $12,000 a month consumes $24,000 of the very proceeds the plan depends on.
Legitimate spend-down targets: facility bills the client actually owes, paid as they come due; an irrevocable funeral and burial arrangement within West Virginia’s limits; medical, dental, vision, and hearing expenses Medicare does not cover; home repairs or modifications for a community spouse remaining in the home; retiring debt the client is legally obligated on; and a replacement vehicle. Each needs an invoice and a paid receipt.
Timeline for the transaction: a standard life settlement runs roughly 60 to 120 days from submission to funding — carrier verification of coverage, medical records retrieval, life expectancy underwriting, offer, contract, carrier ownership change, escrow release. In rural West Virginia, records retrieval from small practices and critical access hospitals is the usual bottleneck, and mail and notarization add days. Tax treatment belongs with a CPA. The Tax Cuts and Jobs Act of 2017 eliminated the cost-of-insurance reduction that prior IRS guidance applied to basis in a life settlement, which generally raises basis and reduces taxable gain. West Virginia imposes a state personal income tax, with rates reduced by 2023 legislation and subject to further triggered reductions, so the state-level bite on a gain is real but smaller than it was. Code Chapter 33, Article 13C, beginning at § 33-13C-1, administered by the West Virginia Offices of the Insurance Commissioner. As of 2026, confirm current section text before it goes into a client memo. The framework provides that a buyer must hold West Virginia authority to purchase from a West Virginia resident, that disclosures including the existence of accelerated death benefit alternatives must precede signature, that a statutory rescission right applies, and that funds are expected to move through an independent escrow agent.
