Pull the policy specification page and read the plan description. A declared-rate contract typically reads flexible premium adjustable life insurance policy. These are three different products with three different risk profiles, and people mix them up constantly.

Then read the issuing company name. Depending on where and how the policy was written, it will be one of the following:

  • Allstate Life Insurance Company, NAIC company code 60186, Illinois-domiciled — now Everlake Life Insurance Company, still regulated as to domicile by the Illinois Department of Insurance. How index crediting actually works inside the policy

Indexed universal life does not put your money in the market. The insurer holds general account assets, buys options referencing an index such as the S&P 500 Price Return Index, and credits interest by formula. Understanding the formula is easier if you follow a single dollar through it.

Premium arrives and is reduced by a premium load. What remains enters an index segment on a segment start date, and that segment is locked for its term, normally twelve months. At the segment maturity date the insurer measures index movement from start to end, applies the participation rate, applies the cap, and credits the result — never less than the floor, usually 0%. The credited amount joins the account value, and a new segment begins.

Three consequences follow that illustrations do not make obvious. Money sitting between segments earns only the fixed account rate, so timing of premium payments matters. Most strategies use price return, excluding dividends, which is a persistent drag against the total return figures quoted in the news. And caps and participation rates are non-guaranteed: the insurer may reset them on in-force business down to a contractual minimum that is usually far below the rate in effect at issue. On a run-off block with no new sales to protect, there is no competitive pressure on those renewal rates — a structural point worth naming plainly. The critical misunderstanding is what the floor protects. It protects the credit, not the balance. In a 0% year the policy still deducts every monthly charge, so the account value falls.

The charge that decides the outcome

Each month the insurer subtracts the cost of insurance charge, a per-policy administrative charge, a per-thousand charge on the face amount, and any rider charges. The cost of insurance is the one that grows.

It is calculated on the net amount at risk — the death benefit minus the account value — at a rate per thousand tied to the insured’s attained age. Both inputs move against the policyholder over time. The rate per thousand climbs sharply after the mid-seventies. And as the account value erodes, the net amount at risk expands, so a rising rate is applied to a growing base.

Add sequence risk. A policy sold on a 7% assumed credit was modeled as though 7% arrived every year. Real index sequences deliver zeros. Three flat years in the first decade do not merely cost three years of credits; they permanently shrink the base compounding for the following thirty. That is how a contract that looked comfortable at year five ends up projecting a lapse at year twenty-two.

Then there is the loan question. Many indexed contracts were sold on the premise of tax-free retirement income through policy loans. The NAIC has tightened indexed life illustration rules three times in less than a decade, and the sequence tells you what regulators concluded about the earlier numbers.

AG 49 took effect in 2015, limiting the maximum illustrated crediting rate through a lookback formula tied to the insurer’s actual hedge budget rather than to whatever the carrier wished to show. AG 49-A, effective in late 2020, addressed designs using multipliers and bonused index accounts that had been engineered to illustrate better than plain designs, and it constrained the illustrated benefit of loan arbitrage. AG 49-B applies to illustrations from May 2023 and further limited the treatment of proprietary and volatility-controlled indices, which had become the new route to an attractive-looking ledger.

If your contract predates any of these, the ledger in your folder was compliant when printed and is not a forecast. Treat it as a sales document.

Replace it with an in-force illustration, requested in writing and in three versions: current charges at current caps, current charges at a 0% index credit each year, and guaranteed maximum charges at the guaranteed minimum cap. MEC status, the material change rule, and why timing matters

A contract that fails the seven-pay test in Internal Revenue Code section 7702A is a modified endowment contract, permanently. Indexed universal life sits closest to that line because maximum funding is the design premise.

Less well known is the material change rule: certain changes to the contract — notably an increase in the death benefit or the addition of certain benefits — can restart the seven-pay test and retest the policy under the new terms. A policy that was safely non-MEC for twenty years can be pushed over the line by a modification made without checking. Anyone contemplating a face amount change, a rider addition, or a restructuring should ask the carrier in writing for a seven-pay test calculation before the change is made, not after.

Why it matters for a keep-or-sell decision: in a MEC, distributions are taxed gain-first, loans count as distributions, and an additional 10% penalty generally applies before age 59 and a half. The strategies that make holding attractive — borrowing against cash value, taking withdrawals — become expensive. It does not stop a sale, because a buyer prices the death benefit and premium stream rather than your basis, but it changes which alternative nets more.   5. Get the surrender value in writing. It is the floor beneath which no offer should be accepted.
