Its life portfolio is term, whole life and final expense, much of it sold at the worksite. Aflac Incorporated is headquartered at 1932 Wynnton Road in Columbus, Georgia, but the headquarters address is not the domicile, and the domicile is what determines the primary regulator. The principal U.S. underwriter, American Family Life Assurance Company of Columbus (NAIC company code 60380), is domiciled in Nebraska and appears in Nebraska Department of Insurance financial examination reports and appointment filings. American Family Life Assurance Company of New York issues New York business under the supervision of the New York State Department of Financial Services. Continental American Insurance Company, marketed as Aflac Group Insurance, writes much of the group and worksite block. Tier One Insurance Company, also a Nebraska-domiciled Aflac subsidiary, underwrites the Aflac final expense product, which is administered by Aetna Life Insurance Company.

That last arrangement is worth pausing on, because it is the sort of detail that quietly derails paperwork later. A policyholder who believes Aflac issued the contract may be corresponding with an Aetna service center about a Tier One policy. When you request documents, verification of coverage, or an in-force illustration, address the request to the entity named on the contract, not to the brand on the marketing material.

None of these entities offers an indexed universal life product in the 2026 consumer lineup. That is a factual statement about the product shelf, not a judgment about the company. Telling apart the three things people call an Aflac policy

Supplemental health coverage. Accident, critical illness, cancer, hospital indemnity and short-term disability contracts pay benefits for events, not for death. They accumulate no cash value, have no death benefit that a third party could purchase, and are not assignable in any way that produces a lump sum. There is no secondary market for them, and no legitimate buyer will bid on one. If your document lists a benefit schedule by procedure or diagnosis rather than a face amount, this is what you have.

The second category is group life certificates. If the top of the document says certificate of insurance and references a group policy number held by your employer or association, you are a participant under someone else’s master contract. Certificates generally cannot be assigned or sold, coverage frequently ends when employment ends, and the only route to an individually owned policy is the conversion privilege — which on standard group life carries a 31-day window from the date coverage terminates. The third category is an individually owned permanent policy from another carrier. Agents appointed with Aflac are frequently appointed with several life carriers, and an indexed universal life contract sold in an Aflac-branded meeting may have been issued by an unrelated insurer. Indexed universal life credits interest by a formula rather than by investing your money in the market. Three settings do the work. A floor, usually 0%, prevents a negative credit in a down index year. A cap limits the credit in a strong year. A participation rate determines what fraction of index movement counts before the cap is applied. Most strategies also use price return, excluding dividends, and most caps and participation rates are non-guaranteed elements the insurer may reset on in-force policies down to a contractual minimum.

The consequence that matters for a keep-or-sell decision is that the floor protects the credit, not the balance. Monthly deductions come out regardless. In a 0% credit year the account value falls by the full amount of the cost of insurance charge, the administrative charge, the per-thousand charge and any rider charges. Two or three of those years early in a contract can move the projected lapse date forward by a decade, because the compounding base never recovers. Layered on top is the cost-of-insurance curve. The charge is calculated on the net amount at risk — face amount less account value — at a rate per thousand that rises with attained age. A policy that cost a modest amount per month at 52 can cost many multiples of that at 79, at exactly the point the account value is thinnest. This is why the phrase “it is a permanent policy” is misleading on a universal life chassis: it is permanent only if it stays funded.

AG 49 and why the original illustration is not evidence

Illustrations for indexed products sold before 2015 were produced under rules that placed no standardized ceiling on the assumed index credit, and competitive pressure pushed those assumptions steadily higher. The National Association of Insurance Commissioners responded with Actuarial Guideline 49 in 2015, which limited the maximum illustrated rate using a lookback tied to the insurer’s actual option budget. AG 49-A followed in late 2020 to stop bonused and multiplier designs from illustrating better than plain ones. AG 49-B took effect for illustrations from May 2023, further constraining index accounts built on proprietary or volatility-controlled indices.

What replaces it is an in-force illustration requested from the carrier in writing, in three versions: current charges at the current cap, current charges at a 0% credit every year, and guaranteed maximum charges at the guaranteed minimum cap. Where the MEC line sits and why it changes the comparison

A contract funded faster than the seven-pay limit in Internal Revenue Code section 7702A becomes a modified endowment contract, permanently. Indexed universal life is the design most likely to brush that line because maximum funding is the whole strategy.

The classification does not affect whether a policy can be sold. It affects what each alternative nets you. Distributions from a MEC are taxed on a gain-first basis, policy loans are treated as distributions rather than as loans, and an additional 10% penalty generally applies before age 59 and a half. That turns the familiar advice to “borrow against the cash value instead” into a potentially expensive move, and a lapse carrying a large loan balance can generate taxable income with no cash arriving to cover it.
