Under the pre-2022 rules a single applicant could hold about $2,000 in countable resources, and families in Carlsbad routinely emptied CDs at a penalty to get under it. That particular panic is still misplaced. Since January 1, 2026 the governing figure has been $130,000 for one applicant, plus $65,000 for each additional household member, a ceiling most Carlsbad households clear on liquid savings without restructuring anything. Checking, savings, CDs and investment accounts all count toward it, so total them up rather than assuming: the number to stay under is generous, not absent.

What still bites is income. Long-term-care Medi-Cal charges a monthly share of cost: nearly all of the resident’s income goes to the facility, and the resident keeps only a small personal needs allowance – historically about $35 a month in California, one of the lowest in the country. Verify the 2026 figure with DHCS or the county. Interest, dividends, annuity payments and required minimum distributions are income, so a large cash position can still raise the share of cost even though the principal is not counted.

Practical consequence: do not cash out a CD, do not take an early annuity distribution, and do not sell an appreciated asset in a hurry. The principal residence has long been exempt while the applicant lives in it or states an intent to return. That has not changed. What deserves real attention in Carlsbad is what happens afterward, because the numbers here are unusual: Carlsbad’s median home value has run in the range of roughly $1.3 million to $1.5 million as of 2026, against a California statewide median closer to $800,000. A modest 1970s tract house on the wrong side of El Camino Real is still a seven-figure asset.

California narrowed its Medicaid estate recovery program substantially for deaths occurring on or after January 1, 2017. Recovery is now limited to assets that pass through the probate estate, is capped at the value of that estate, and does not reach assets that pass outside probate – property held in a living trust, in joint tenancy, or by beneficiary designation. Household goods, jewelry and a burial plot. Household and personal effects were exempt; a burial plot and prepaid, irrevocable funeral arrangements have their own treatment. An irrevocable funeral trust is a sensible planning tool again now that California counts resources, and for a household near the $130,000 line it is frequently the cheapest way to convert countable cash into an exempt purpose.

A second property. This is the line that moved most in 2026. Rental or vacation real estate – common enough along the North County coast – is countable property, and at Carlsbad-area valuations one additional parcel can carry a household past $130,000 by itself. Transfers and the Look-Back: The Part Californians Get Wrong in Both Directions

The federal baseline, and the rule in nearly every state, is a 60-month look-back at gifts and below-market transfers, with a penalty period calculated by dividing the amount given away by the state’s average monthly private-pay nursing facility rate. California is the exception families misread in both directions. It never implemented the longer look-back created by the federal Deficit Reduction Act of 2005, and it applies a 30-month period for nursing-facility-level care, which is a genuine advantage. But the transfer rules came back into active use alongside the asset limit on January 1, 2026, so the idea that gifts no longer matter in California is now simply wrong. Two and a half years of transfers are in scope for a Carlsbad application filed today.

Two cautions. First, California has moved this policy three times in four years, so confirm the look-back in writing with DHCS or San Diego County HHSA rather than trusting any article, this one included – and do not confuse it with the federal gift tax annual exclusion, which is a tax rule and has nothing to do with Medi-Cal. The Last Line: The Life Insurance Policy

Here is the rule that generic articles get wrong for California, and that still governs in most other states. Medicaid programs aggregate the face value of all life insurance on the insured. If the combined face value stays at or below a small threshold – $1,500 in California and many other states – the policies are excluded entirely and their cash value is ignored. Cross the threshold by a dollar and the entire cash surrender value becomes a countable resource. In California as of 2026 that cash value is counted again, but against $130,000 rather than $1,500, so on a typical Carlsbad policy it is absorbed rather than disqualifying; ask the county how it is treating yours. The policy deserves a hard look for a second reason regardless: premiums. A whole life or universal life policy costing $400 to $1,200 a month competes directly with the share of cost and with the family’s own budget, and a lapse destroys the entire death benefit for nothing.

If the insured is in genuinely good health for their age, projected life expectancy is long, offers compress, and keeping or reducing the policy usually wins.

And if a surviving spouse will need that death benefit – to cover a mortgage, to replace a pension that stops at death, or to fund her own care later – the policy is not surplus, it is the plan.
