Two things to look for specifically while you are in the drawer. Statements from banks or credit unions that no longer exist under that name, which signal accounts that were closed or absorbed and will still need documentation. And any correspondence from an employer benefits office, because that is usually the thread that leads to a group life certificate.

Pass Two: What Institutions Have to Send You

Nothing in this pass can be produced by the family, so request all of it on the same day.

Banks and credit unions: sixty months of statements for every account, including accounts closed inside the window. Expect a fee and one to three weeks. The closed account nobody remembered is the single most common cause of a reopened review.

Life insurance carriers: a current in-force statement showing owner, insured, current face amount, current cash surrender value, any outstanding policy loan, the paid-to date and the beneficiary designation. Two to four weeks, and longer when the original insurer has been acquired or renamed.

Plan administrators: current statements for every pension, annuity and retirement account, including survivor elections.

County records: deeds and assessed values for every property the applicant’s name has touched in five years.

Funeral homes: the prepaid contract with revocable or irrevocable status visible on its face. Only a properly structured irrevocable arrangement is generally excluded, and families believe they have one far more often than they do.

Pass Two Continued: The Out-of-State Requests

This is the Berkeley County addition, and it is why the local timeline runs long. Berkeley County is West Virginia’s fastest-growing county, and the growth has come from the Washington and Baltimore markets, drawn by lower housing costs and an easy commute. The result is a documentary footprint spread across state lines.

Request these early, because they are the slowest items in the file. A deed and settlement statement for any home sold in Maryland, Virginia or elsewhere during the look-back window; if it was sold to a relative below market, that is a transfer regardless of which state it sat in. Pension and retirement statements from an out-of-state or federal employer, which routinely take a month. Vital records from a birth state, which can take weeks. And, critically, employer group life documentation from a Maryland, Virginia or District of Columbia employer, including whether coverage continued into retirement and whether a conversion right was ever exercised.

One reassurance and one warning. Where a policy was purchased does not change how West Virginia counts it. But a group certificate that terminated when employment ended, with a conversion window of roughly 31 days that nobody used, is coverage that no longer exists, and no amount of paperwork brings it back. Pass Three: Documents That Do Not Exist Until Someone Creates Them

These four items cannot be requested. Somebody has to draft, sign or fund them, and each one has a lead time that families discover too late.

A power of attorney that a carrier will accept. If a parent lacks capacity and there is no durable power of attorney, or the existing one does not clearly authorize insurance transactions, an agent may be able to file the Medicaid application and still be refused by the insurer. Guardianship, if needed, takes months. Check this in pass one and fix it in pass three.

A written personal care agreement. If an adult child has been paid for caregiving, it needs a written agreement executed before the care, at a reasonable rate, with records of hours and payments. Drafted after the fact, it is not persuasive.

An irrevocable funeral arrangement. Converting countable dollars into a properly structured irrevocable arrangement is a recognized way to reduce countable assets for something the family will need regardless. The drafting matters and the word irrevocable does all the work.

An income trust, if West Virginia requires one in your case. Ask the Department of Human Services directly how income above the applicable limit is handled and whether a trust is required, because this mechanism differs by state and the answer determines whether income is a solvable problem or a barrier. Where a trust is needed, it has to be drafted, an account opened, and generally funded in each month coverage is sought.

Face value decides exclusion. West Virginia excludes life insurance as a burial resource only if the total face amount of all policies on the same insured stays at or under the state threshold, a figure derived from federal SSI rules that most states set at $1,500. Confirm the current West Virginia number with the Department of Human Services. The test aggregates, so two $1,000 policies do not each get excluded; their combined face amount is measured and exceeding the threshold destroys the exclusion for all of them.

Cash surrender value counts if the exclusion is lost. Not the death benefit. A $35,000 whole life policy with $5,700 of cash value and a $900 loan is a $4,800 countable asset. Term insurance, including a group certificate, generally has no cash value and is generally not countable, though it still gets disclosed.

If the cash value puts the household over the limit, four exits exist. Absorb it in documented allowable spending. Surrender the policy for its cash value. Elect reduced paid-up coverage, which many whole life contracts allow at no further premium and which can bring the face amount under the burial threshold so the policy stops counting at all; this is the most overlooked option in these files. Or sell the policy in a life settlement, which can exceed surrender value for an older insured with health impairments and takes roughly two to four months from application to funding. The Look-Back Trail in Five Years of Statements

West Virginia reviews the 60 months before the application date for transfers made for less than fair market value. A disqualifying transfer creates a penalty period during which Medicaid will not pay for long-term care, computed by dividing the transferred value by a statewide average monthly private-pay figure. Confirm the current divisor with the Department of Human Services, because the number of penalty months moves with it.

Read the statements yourself before a caseworker does. In this county the recurring findings are a property or a parcel deeded to a child, money moved into an adult child’s account for convenience, help with a grandchild’s tuition, a vehicle signed over, and payments to a family caregiver with no written agreement. West Virginia recognizes exceptions, including certain transfers involving a spouse, a blind or disabled child, and a caregiver child who met residence and care requirements, and a full return of transferred value can potentially cure a transfer. Every one of those requires documentation and an elder law attorney, promptly.

A life insurance sale documented at arm’s length for fair market value is not a penalized transfer. A discounted sale or assignment to a relative is. Keep the offer sheet, the closing statement and the deposit record in the file.

What a Month Costs, and Why Home Equity Matters Here

The Eastern Panhandle prices closer to the neighboring Maryland market than to southern West Virginia. As of 2026, semi-private skilled nursing in the Martinsburg area generally runs about $11,000 to $12,800 a month with private rooms roughly $12,000 to $14,000, and assisted living about $4,500 to $5,800, based on Genworth-style cost-of-care survey data for West Virginia and the adjacent Maryland market trended forward. These are ranges; get each facility’s current private-pay rate in writing.

Now the local fact that changes the spend-down math. Because Berkeley County has absorbed commuter and retiree demand from the Washington and Baltimore markets, home values here have appreciated well beyond typical West Virginia levels, while much of the state’s housing stock has not. West Virginia, like every state, is required to seek recovery of long-term care Medicaid costs from the estates of deceased recipients. Exceptions and hardship provisions exist, including protections while a surviving spouse or a disabled child is living, and the treatment of jointly held property and of property passing outside probate is fact-specific. Given local property appreciation, this matters more in Berkeley County than in most of the state. Ask the Department of Human Services or your own attorney what applies in 2026.

The insurance connection is structural: a death benefit paid to a named individual beneficiary is generally outside the probate estate, while cash in the decedent’s account at death generally is not. Confirm the beneficiary designation while you are requesting the in-force statement.

A small face amount in the $5,000 to $10,000 range will not draw a competitive third-party offer; surrender or a reduced paid-up election is simpler. A healthy insured draws weak offers because pricing tracks life expectancy, and the family gives up a full death benefit cheaply. And a surviving spouse who needs the coverage changes the analysis: West Virginia protects a share of assets and income for the spouse remaining at home, and liquidating the household’s only life insurance to accelerate the other spouse’s eligibility can leave the survivor in Hedgesville or Inwood worse off.
