A life insurance policy is an asset of the protected person, and a conservator generally cannot sell an asset of the protected person without authority — so build this around the petition, not around the transaction. The question your court will ask is not whether a life settlement is a good idea in the abstract. It is whether you established what the policy was worth, considered the alternatives, and can explain why the sale served this protected person.
Arizona adds a layer most states do not. Professional fiduciaries here are licensed and regulated through the Arizona Supreme Court’s fiduciary licensing program, with conduct standards in the Arizona Code of Judicial Administration, on top of the conservatorship and guardianship provisions in Title 14 of the Arizona Revised Statutes. That means a poorly documented sale is both an accounting problem and a licensing problem. Confirm the current 2026 rule text and your county’s local practice with counsel before filing.
Send a redacted policy cover page. A valuation costs nothing and creates no obligation, which is precisely what makes it useful evidence for a petition. One page starts it — the policy cover or declarations page. The review is free and usually back within one to two business days. Call (305) 209-7183.

Authority First: The Petition Is the Product
Treat the market test as fact-gathering that precedes the request for authority, not as a transaction you are trying to get blessed after the fact. The sequence that reads well to a court: identify the policy, obtain the carrier’s stated cash surrender value and a current in-force illustration, obtain at least one market-tested indication of value, compare the options in writing, and then petition for authority to sell if the comparison supports it.
Arizona’s conservatorship provisions in A.R.S. Title 14 govern what a conservator may do with estate property and when court approval is required, and practice varies by county and by the terms of your letters. Nothing in a free policy valuation commits the estate, which is why obtaining one before the petition is the conservative path rather than the aggressive one. Have counsel confirm the scope of your existing authority before you rely on it.
The Four Documents That Should Be in the File
Whatever the outcome, the file should contain four things. First, the current in-force illustration — it shows what premiums are required to keep the policy alive and when it is projected to lapse, which is the fact that usually drives the analysis. Second, the carrier’s stated cash surrender value, in writing, as of a specific date. Third, at least one market-tested indication of value from the secondary market. Fourth, a written statement of why the policy no longer serves the protected person.
That fourth document is the one fiduciaries skip and courts want. It is usually short: the beneficiaries no longer depend on the death benefit, the premium is consuming income needed for care, the estate cannot sustain the policy to maturity, or the coverage was purchased for an estate-tax exposure that no longer exists. Two sentences of reasoning, contemporaneous with the decision, is worth more than any amount of reconstruction later.
Surrender Is a Decision, Not a Default
The reflexive move — surrender the policy, book the cash value, move on — is a decision with consequences, and it is the one most likely to be questioned. Cash surrender value is a number the carrier prints. What an unrelated buyer will pay for the death benefit is a different number, and for an insured in declining health those figures are not close. The GAO’s 2010 study of the secondary market (GAO-10-775) found settlement proceeds substantially exceeded cash surrender value on the policies examined, with market-wide pricing commonly cited in the range of roughly 10% to 35% of face value.
You are not required to sell into the secondary market. You are in a much better position if the record shows you found out what it would have paid. A one-page comparison of lapse, surrender, reduced paid-up, and settlement — with real numbers next to each — is the cheapest protection available. See settlement versus surrender for the framework.
| Step | What the fiduciary does | What goes in the record |
|---|---|---|
| 1. Inventory | Identify every policy on the protected person, including group and employer coverage | Policy cover pages, carrier names, face amounts |
| 2. Value | Request cash surrender value in writing and a current in-force illustration | Carrier statement dated as of a specific day |
| 3. Market test | Obtain at least one indication of secondary-market value at no cost | Written indication and the date it was obtained |
| 4. Compare | Weigh lapse, surrender, reduced paid-up, and sale side by side | One-page written comparison with real numbers |
| 5. Petition | Seek court authority to sell where the comparison supports it | Petition, supporting exhibits, order |
| 6. Account | Report proceeds and their application to the protected person’s care | Escrow disbursement record, carrier confirmation, receipts |

Annual Accounting and What Happens to the Proceeds
Proceeds are estate property and get reported in the annual accounting like any other receipt. Expect the account to be read alongside the question of application: what did the money do for the protected person. Funds applied to care costs, an accessible vehicle, home modifications, a prepaid burial arrangement, or private-pay days while an ALTCS determination is pending all tell a coherent story. Funds sitting in a low-yield account for eighteen months invite a different question.
Keep the escrow agent’s disbursement record showing the amount and date, the carrier’s confirmation of the ownership and beneficiary change, and receipts tying disbursements to the protected person’s needs. Arizona’s fiduciary conduct standards and accounting requirements are administered through the courts and the Supreme Court’s fiduciary program; verify the current 2026 forms and reporting expectations in your county.
Prudence Standards Apply to a Policy Too
Fiduciaries generally do not think of a life insurance contract as an investment position, so it does not get monitored the way a securities account does. That is the gap. Under prudent-investor principles — codified in Arizona’s trust code and reflected in fiduciary practice standards — the duties that attach to an asset are to know what you hold, monitor its performance, and act when it stops serving its purpose. A universal life policy with rising cost of insurance charges eating a thin account value is an asset that is actively deteriorating.
The practical translation for a conservatorship or guardianship file: put policy review on the same annual calendar as the investment review. Ask for an in-force illustration each year. If the projected lapse date has moved closer, that is a triggering event, not a footnote.
Screening: Which Policies Justify the Effort
A petition costs the estate money, so screen before you draft. The profile that has real secondary-market value: an insured roughly 70 or older, or any age with a material health change since issue; a death benefit of $100,000 or more; and permanent coverage — whole life, universal life, guaranteed universal life — or term still inside its conversion window. Two years in force clears the usual waiting-period rules.
Small face amounts, expired-conversion term, and a healthy insured in their early sixties generally do not price. Neither does a policy the protected person’s dependents actually still need. Our page on what policies qualify gives you the screen in one page, and how cash surrender value works is useful when explaining the comparison to a family member.
How a Referral Works
With appropriate authority, you send one document: the policy cover page. It identifies the carrier, product type, face amount, and issue date — enough for a preliminary read on whether the policy is worth pursuing. No fee, no engagement, no obligation to the estate or to you personally.
That read typically comes back within one to two business days. If the policy looks viable, three more documents produce an indicative range: a current in-force illustration, the latest carrier statement, and a signed HIPAA authorization. From complete documentation through funding, a standard file usually runs about 60 to 120 days — plan the petition calendar around that, not against it.
You stay in control the entire time. Nothing proceeds without your authority, the file can stop at any point before closing, and any indication of value can go into your petition whether or not a sale ever happens. Call (305) 209-7183 or send the cover page for a free review.
This page is educational only and is not legal, tax, or investment advice for you or a protected person. Nothing here is an offer to purchase a policy. Independent counsel should confirm your authority and your court’s requirements before any transaction is executed.
Frequently Asked Questions
Does a conservator need court approval to sell a policy?
A life insurance policy is estate property, and Arizona’s conservatorship provisions in A.R.S. Title 14 govern when court authority is required to deal with estate assets. Practice also varies with the terms of your letters and with local county rules. Confirm the scope of your authority with counsel before proceeding rather than assuming a general grant covers it.
Can I get a valuation before I have authority to sell?
Obtaining a free indication of value creates no obligation and commits the estate to nothing, which is exactly why it is useful evidence for a petition. The document that matters to the court is the comparison, and you cannot build the comparison without the number. Counsel should still confirm this fits your court’s expectations.
What makes Arizona different for professional fiduciaries?
Arizona licenses and regulates professional fiduciaries through the Arizona Supreme Court’s fiduciary program, with conduct standards set out in the Arizona Code of Judicial Administration. That means documentation failures carry licensing exposure in addition to accounting exposure. Verify the current 2026 rule text and requirements.
How do proceeds interact with ALTCS eligibility?
Arizona’s Long Term Care System applies a $2,000 individual countable-asset limit as of 2026, so proceeds held and unspent are countable. A sale at fair market value to an unrelated buyer is not an uncompensated transfer and should not create a look-back penalty. Coordinate the disbursement with the protected person’s Medicaid planner or elder law counsel.
What if beneficiaries object to a sale?
Beneficiary expectations are not the fiduciary’s duty; the protected person’s interests are. That said, notifying interested parties and letting the court hear objections is usually the cleaner path than proceeding quietly. Counsel should advise on notice requirements in your county.
How much more than cash surrender value is realistic?
GAO-10-775 found settlement proceeds substantially exceeded cash surrender value on the policies it examined, and market-wide pricing is commonly cited in the range of roughly 10% to 35% of face value. Every policy prices differently based on age, health, face amount, and premium load, so only a current valuation on that policy means anything.
How long does the process take?
A standard file runs about 60 to 120 days from complete documentation through funding, plus whatever time the petition and order require. Build the two timelines in sequence when planning around a lapse date or a Medicaid application.
Who regulates life settlement transactions in Arizona?
Arizona addresses viatical and life settlement transactions in its insurance code at A.R.S. Title 20, with oversight by the Arizona Department of Insurance and Financial Institutions. Confirming licensure and requiring an independent escrow agent are reasonable diligence steps for a fiduciary file.
