The Screen: What a Policy in Trouble Looks Like

Five observable findings, none of which require reading the contract.

  1. A stopped premium. Individual life policies generally provide a grace period of at least 31 days after a missed due date, and many allow reinstatement afterward on evidence of insurability. Get the date of the last payment. If it was last month, there is time. If it was in 2023, there usually is not.
  2. Mail the family cannot decode. Grace notices and lapse warnings arrive looking like solicitations. Photograph the date on anything in the property bag.
  3. A universal life contract issued before 1995. These were sold on interest assumptions that never materialized. The owner has paid faithfully for thirty years and the contract is still failing, because cost-of-insurance deductions climb with attained age and eventually outrun the premium.
  4. A loan against the cash value. Loans compound. When the balance approaches cash value, the policy collapses and can generate taxable income on gain the family never touched. Route this to a CPA before anything else.
  5. No remaining need for the death benefit. Predeceased beneficiary, mortgage retired, children financially independent.

Two additional New Mexico patterns are worth naming. First, orphaned policies — the selling agent retired or the agency closed years ago, and nobody has reviewed the contract since. Present the Whole Board: Six Options, in Order of Cost to Explore

The most common professional error here is not recommending badly. It is presenting one option because it is the one you happened to hear about.

Living benefit riders — free. Accelerated death benefit, terminal illness, chronic illness, and long-term care riders live inside the existing contract. Internal Revenue Code section 101(g) generally excludes qualifying accelerated payments from income for a terminally or chronically ill insured. Always the first call.

Reduced paid-up insurance — free. Existing cash value buys a smaller, fully paid-up policy. Premiums stop, some coverage survives.

Extended term insurance — free. Full face amount preserved for a defined number of years using existing cash value.

Surrender — free to request. The carrier pays cash surrender value, computed by formula and entirely indifferent to the insured’s health. That indifference is precisely why an impaired older insured often forfeits real value by surrendering.

1035 exchange. Reposition cash value into a different contract without triggering tax, when the goal is affordable coverage rather than cash.

Life settlement. A licensed provider purchases the policy, assumes the premiums, and becomes owner and beneficiary. The federal GAO study of this market (GAO-10-775) found sellers typically received roughly 10 to 35 percent of face value and multiples of the surrender value on the same contracts.

Turquoise Care, the Health Care Authority, and Proceeds

New Mexico Medicaid is administered by the New Mexico Health Care Authority, the agency created when the Human Services Department was restructured in 2024, and delivered largely through Turquoise Care managed care organizations.

One New Mexico-specific issue deserves explicit flagging rather than a guess. These interact with the analysis in ways that are genuinely fact-specific. Do not resolve them at the bedside. The Referral Packet, Authority to Sign, and Timing

Four documents make the file usable: the policy cover page showing carrier, policy number, face amount, issue date, and owner of record; the most recent annual statement, which discloses cash value, loan balance, and often a projected failure date; the current premium notice; and the rider schedule. A HIPAA authorization follows once the family decides to proceed, because life expectancy underwriting requires medical records and that is the slowest step in the process.

Then confirm authority. The owner of record signs — not the insured, not the payer, not the most present adult child. If capacity is impaired, an agent under a durable power of attorney can act only where the instrument expressly grants insurance authority, including the power to assign, surrender, or dispose of a policy. Carriers reject silent instruments as a matter of routine.
