Two of the agency names a New Mexico practitioner needs for this analysis changed recently, and using the old ones will send a client to the wrong place. The Medicaid agency is the New Mexico Health Care Authority, renamed from the Human Services Department effective July 1, 2024, and the managed care program is Turquoise Care, which replaced Centennial Care on the same date. The insurance regulator has been the Office of Superintendent of Insurance since it was separated into a standalone agency in 2013. Getting these right is not pedantry; it is the difference between a client reaching a caseworker and reaching a disconnected number.

The substance underneath is that life insurance is the one major asset people routinely abandon without checking whether it can be sold. A lapse returns zero. A surrender returns whatever cash value survived decades of mortality charges. Federal research on the secondary market (GAO-10-775) found policyholders who sold typically received roughly 10% to 35% of face value and, on average, several multiples of cash surrender value. In New Mexico the regulator is the Office of Superintendent of Insurance, led by the Superintendent of Insurance, which has operated as an independent agency since the 2013 restructuring that moved insurance regulation out of the Public Regulation Commission. The governing provisions sit in Chapter 59A of the New Mexico Statutes Annotated 1978, the New Mexico Insurance Code, within the article addressing viatical and life settlements. Read the current sections rather than a secondary summary.

What the framework does for your client is specific. Providers and brokers must be licensed, and license status is verifiable through OSI. A rescission period follows execution of the settlement contract, meaning a signature is not the end of the client’s optionality. Disclosure obligations attach to the buying parties. And a broker’s duty runs to the policy owner while a provider is the buyer with its own required return; that distinction is the single most useful thing you can give a client contacted by someone describing themselves as both. Two bright lines for clients before they take any unsolicited call: no legitimate transaction requires the policy owner to pay a fee in advance, and no genuine institutional offer expires in 48 hours. New Mexico is a community property state, and that shapes the intake more than the economics do.

Classification. Property acquired during the marriage is presumed community. A policy funded with community earnings is generally a community asset regardless of whose name appears as owner on the declarations page. Where premiums came from separate property, an inheritance, or assets owned before the marriage, the tracing question is a legal analysis for the client’s attorney rather than a workpaper entry.

Consent. A licensed buyer’s closing package will expect both spouses to participate in a transaction affecting a community-classified policy. Raise this at the first meeting, because discovering a missing signature at closing costs weeks and, where one spouse has since lost capacity, can end the transaction entirely.

Capacity and authority. If the insured has a durable power of attorney, confirm that the instrument contains express authority over insurance contracts; many general powers do not, and a buyer’s counsel will read the document rather than accept a summary. Where a court-appointed guardian or conservator holds authority, court approval may be required before any disposition. Turquoise Care and New Mexico Medicaid Thresholds

New Mexico Medicaid is administered by the New Mexico Health Care Authority, the agency created when the Human Services Department was renamed effective July 1, 2024. Managed care operates as Turquoise Care, which replaced Centennial Care on that same date, and includes community benefit services covering home and community-based long-term care. The eligibility numbers that intersect with a life insurance policy, as of 2026:

Resources. $2,000 countable for an individual applicant. The community spouse resource allowance follows the federal minimum and maximum, $31,584 and $157,920 for 2025, indexed annually. Confirm current figures with the Health Care Authority.

Income. New Mexico applies the special income limit for institutional eligibility, equal to 300% of the SSI federal benefit rate, which was $2,901 per month in 2025 and adjusts each January with the Social Security cost-of-living increase. Applicants above the cap generally require a qualified income trust established and funded before the application rather than afterward.

Life insurance. Where the aggregate face value of all policies on the insured exceeds $1,500, the entire cash surrender value counts as a resource; at or below that aggregate, cash value is excluded. The test aggregates across policies, which is what catches families who own several small contracts.

Two sequencing rules. Proceeds from a sale are countable cash in the month after receipt, so a settlement does not create eligibility; it creates a documented private-pay runway. And a sale for less than fair market value, particularly to a relative, can be recharacterized as an uncompensated transfer and trigger a penalty period under the 60-month look-back. Finding the Policy and Pricing Every Exit

The asset surfaces in three ways: a premium the client mentions as a cash-flow problem, an unexpected Form 1099-R from a life carrier, or a term policy approaching a conversion deadline. Any of the three should trigger a document request.

Five documents, one email: the policy cover page, the most recent annual statement, an in-force illustration run at current charges, the rider schedule, and the carrier’s cost basis statement. The in-force illustration is the one that matters most, because it produces the specific date the policy fails if nothing changes, and carriers generally produce it within two to four weeks of a written request.

Then price each exit rather than describing it.

Keep and fund: the carrier’s minimum premium to carry the policy to maturity at current charges. If a survivor or a dependent still needs the benefit and the number fits, the analysis ends here.

Reduced paid-up: the fully paid death benefit the existing cash value supports with no further premiums. A contractual right on most whole life contracts and the answer to a large share of affordability problems.

Extended term: the full face amount preserved for a defined period with no further premium.

Surrender: net cash surrender value after loans and surrender charges. This is the benchmark every offer must beat.

Accelerated death benefit: free to exercise if the rider is in force and the insured meets the terminal or chronic illness definition, and generally excluded from income under IRC section 101(g).

Life settlement: a free eligibility review, then competing offers if the policy qualifies. Say plainly when it is wrong: small final-expense and burial policies generally have no market at any age, an insured in strong health draws low offers, and a beneficiary who still needs the coverage ends the discussion.

The Return: Basis, Character, and the New Mexico Layer

A closed settlement produces two information returns under IRC section 6050Y, enacted in the 2017 Tax Cuts and Jobs Act and implemented by final regulations in 2019. The acquirer files Form 1099-LS reporting the payment made to the seller. The issuing carrier files Form 1099-SB reporting the seller’s investment in the contract and the surrender amount. A client-disclosed settlement with no matching forms is an open reconciliation item.

Character comes from Revenue Ruling 2009-13: recovery of adjusted basis is tax-free, gain from basis up to cash surrender value is ordinary income, and gain above cash surrender value is generally long-term capital gain. TCJA section 13521 eliminated the cost-of-insurance reduction to basis the ruling had originally imposed, retroactive to transactions after August 25, 2009, so basis is generally cumulative premiums paid less nontaxable distributions and outstanding loans.

Where the insured is terminally ill within IRC section 101(g)(4), meaning physician-certified with a life expectancy of 24 months or less, or chronically ill within the statutory definition, a sale to a licensed viatical settlement provider is generally excluded from gross income and reported on Form 8853. The certification must exist at the time of the transaction.

Two New Mexico-specific points on the state layer. First, the state’s individual income tax is graduated, and the legislature restructured the brackets in recent sessions; confirm the current-year rates and New Mexico’s federal conformity position before projecting a net number. Second, New Mexico has historically allowed a deduction for a portion of net capital gain, and the legislature has narrowed that deduction in recent sessions, which bears directly on the long-term capital gain slice of a settlement. Verify the current-year rule rather than carrying a prior year’s assumption forward. New Mexico also exempts Social Security benefits from state income tax below stated income thresholds, which affects the client’s marginal rate in the year of a large gain.

Running the Process Remotely

A meaningful share of New Mexico clients live hours from the nearest CPA office, and the settlement process is more remote-friendly than most families expect. Nearly all of it can be handled without an in-person meeting.

Document collection. The cover page can be photographed with a phone. Carriers accept written requests for in-force illustrations and cost basis statements by mail, secure message, or fax, and will send results directly to the policy owner.

Medical records. The HIPAA authorization the process requires is executed by the insured and used to retrieve records from treating providers. The insured does not attend an appointment or take an exam; life expectancy underwriting is a records-based review.

Signatures. Closing packages typically involve notarization, and requirements vary by state and by carrier. Confirm what form of notarization is acceptable before scheduling, particularly for a client in a facility or a rural county where a mobile notary has to be arranged.

Funds. Proceeds are held by an independent escrow agent and released when the carrier confirms the ownership change. A transaction that does not involve escrow is a transaction to walk away from. See how the process works for rural clients.

On your own boundary: the New Mexico Public Accountancy Board, within the Regulation and Licensing Department, licenses CPAs in the state. The AICPA Code of Professional Conduct prohibits a member performing attest services for a client from accepting a commission or referral fee from that client and requires disclosure where a commission may be accepted.
